1. Scope of Application
These General Terms and Conditions (GTC) apply to all brokerage services provided by PINHOFF GmbH in connection with yacht charter bookings, skipper services, additional services, and related activities.
PINHOFF GmbH acts exclusively as an intermediary agency and arranges charter agreements between the customer and the respective charter company or service provider.
The contractual partner of the charter agreement is exclusively the respective charter company.

3. Online Booking and Electronic Acceptance
By submitting a booking request via website, e-mail, online platform, payment link, or electronic communication, the customer submits a binding booking request.
The customer acknowledges that electronic confirmations, digital approvals, online payments, and checkbox confirmations may constitute legally binding acceptance of these General Terms and Conditions.
PINHOFF GmbH reserves the right to reject booking requests without stating reasons.
4. Conclusion of Contract
All offers made by PINHOFF GmbH are non-binding and subject to availability.
A brokerage agreement becomes effective only when:

the customer confirms the booking in writing, electronically, or verbally, and
-
the booking confirmation is issued by PINHOFF GmbH or the respective charter company.
By making a booking, the customer additionally accepts the terms and conditions of the respective charter company.
5. Brokerage Services
PINHOFF GmbH arranges charter services in the name and on behalf of the respective charter company.
PINHOFF GmbH is neither the owner, operator, nor charter provider of the yachts offered.
The execution of the charter service, technical availability of the yacht, yacht handover, condition of the yacht, and all nautical services are the sole responsibility of the respective charter company.
6. Payment Terms
Unless otherwise agreed, the following payment terms apply:

50% deposit immediately upon booking confirmation
-
Remaining balance no later than 30 days before charter commencement
For short-notice bookings, the full amount may become due immediately.
PINHOFF GmbH is authorized to receive payments on behalf of the charter company.
In case of payment delay, PINHOFF GmbH is entitled to cancel reservations and charge reminder fees and statutory default interest.
7. Prices
Unless otherwise stated, all prices are quoted in Euro.
Additional costs such as:

security deposits
-
final cleaning
-
marina fees
-
tourist taxes
-
fuel
-
skipper fees
-
transit logs
-
special equipment
may be charged separately.
The prices provided by the respective charter company at the time of booking shall apply.
8. Cancellation Policy
Cancellations must be made in writing.
In the event of cancellation, the cancellation conditions of the respective charter company shall primarily apply.
Unless otherwise agreed, the following minimum cancellation fees apply:

up to 90 days before charter start: 30% of the charter price

89 to 60 days before charter start: 50% of the charter price
-
59 to 30 days before charter start: 75% of the charter price
-
from 29 days before charter start or in case of no-show: 100% of the charter price
Already incurred third-party costs or special services shall be charged additionally.
The conclusion of travel cancellation insurance is expressly recommended.
9. Rebooking
Rebookings are subject exclusively to availability and approval by the respective charter company.
There is no entitlement to free rebooking.
Any additional costs or price differences resulting from a rebooking shall be borne by the customer.
10. Customer Obligations
The customer undertakes:

to provide all required licenses, permits, qualifications, and navigation certificates,
-
to provide accurate passport data, crew lists, and identification documents where required by law or charter companies,
-
to comply with the legal regulations of the respective charter country,
-
to handle the yacht properly and carefully,
-
not to exceed the permitted number of persons onboard,
-
to report damages or defects immediately,
-
not to use the yacht for illegal, commercial, racing, transport, smuggling, or unauthorized activities.
The customer is liable towards the charter company for damages caused by negligence, misconduct, incorrect information, or violations of applicable laws and regulations.
11. Skipper and Additional Services
Skippers, crew members, transfers, catering, VIP services, or other additional services may be arranged through third-party providers.
PINHOFF GmbH assumes no liability for services, failures, or damages caused by external service providers.
12. Liability
PINHOFF GmbH is liable solely for the proper brokerage of the booked services.
All yacht descriptions, specifications, images, layouts, equipment lists, technical information, marina information, and availability data are provided by third-party charter companies.
PINHOFF GmbH assumes no liability for the accuracy, completeness, or timeliness of such information.
Changes to yacht specifications, equipment, pricing, availability, crew, marina assignments, or technical details may occur without prior notice.
Liability for:
-
yacht defects,
-
technical failures,
-
service interruptions,
-
weather conditions,
-
force majeure,
-
nautical incidents,
-
harbor restrictions,
-
delays,
-
performance failures of the charter company
is excluded to the extent permitted by law.
Liability for slight negligence is excluded.
Liability for loss of profit, consequential damages, or indirect damages is excluded.
13. Force Majeure
Events of force majeure, including but not limited to:
-
natural disasters,
-
storms,
-
war,
-
pandemics,
-
governmental measures,
-
entry restrictions,
-
strikes,
-
political unrest,
-
technical harbor closures,
-
sanctions,
-
governmental restrictions,
-
travel warnings,
shall neither entitle the customer to damages nor to free cancellation, unless otherwise stipulated by the charter company.
14. Insurance Recommendation
PINHOFF GmbH strongly recommends the conclusion of suitable insurance coverage, including but not limited to:
-
travel cancellation insurance,
-
skipper liability insurance,
-
charter deposit insurance,
-
personal accident insurance,
-
medical and repatriation insurance.
The customer remains solely responsible for obtaining adequate insurance coverage.
15. Data Protection
Personal data is processed in accordance with applicable data protection regulations, in particular the GDPR.
Personal data is processed exclusively for contract fulfillment and the execution of the arranged services.
Data may only be transferred to involved charter companies or service providers to the extent necessary for contract execution.
16. Electronic Communication
The customer agrees that contract-related communication may be conducted electronically via e-mail.
17. Jurisdiction and Applicable Law
Austrian law shall apply, excluding the conflict of law provisions of international private law.
The competent court in Graz, Austria, shall have exclusive jurisdiction for all disputes, unless mandatory statutory provisions provide otherwise.
In the event of discrepancies between translated versions of these General Terms and Conditions, the English version shall prevail.
18. Severability Clause
Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a legally permissible provision that most closely reflects the economic purpose and intent of the invalid provision.
19. Final Provisions
Any deviating agreements must be made in writing.
The General Terms and Conditions of PINHOFF GmbH valid at the time of booking shall apply.
