Terms & Conditions (GTC)

PINHOFF GmbH, MUTINYQUE brand
Last updated: October 2026

These terms are a translation for information only. The German version is legally binding.

1. Scope

These terms apply to all services provided by PINHOFF GmbH ("we") under the MUTINYQUE brand, in particular:

Orders in the shop are governed by the shop's own terms with cancellation policy, shipping and cancellation terms (www.mutinyque.com/de/shop/policies/terms). For business partners, the partner agreement applies; these terms apply in addition.

Customers ("customer") may be consumers within the meaning of the Austrian Consumer Protection Act (KSchG) or businesses. Provisions that expressly apply only to businesses do not apply to consumers. Deviating terms of the customer apply only if we agree to them in writing.

3. We broker, the charter company charters

For yacht charters, we act as a broker. You conclude the charter contract with the respective charter company or the owner of the yacht ("charter company"). It is responsible for the yacht, its condition, handover, crew and all nautical services. The charter contract is also governed by the charter company's terms, insofar as we provide them to you before booking.

We do not sell package travel. If, in addition to the charter, we broker further travel services such as transfers or accommodation, we will inform you before booking if this creates a package travel or linked travel arrangement within the meaning of the Austrian Package Travel Act, and fulfil the related obligations.

4. Enquiry, offer and conclusion of contract

Enquiries via the website, by email or by phone are non-binding. Our offers are subject to change until the yacht is booked, because availability and prices depend on the charter company.

If you enquire about a yacht for specific dates, we reserve it with the charter company, where possible, as a free and non-binding option. The option holds the yacht until the time set by the charter company and then lapses automatically at no cost to you. A booking only results from it as described in the next paragraph or through instant booking (section 5).

If you accept an offer, the booking is binding on you. The charter contract is concluded as soon as the charter company confirms the booking and we send you the booking confirmation. At the same time, a brokerage contract under these terms is concluded between you and us.

5. Instant booking on the website

For yachts with instant booking, you select the yacht and dates and enter your details. With "Book and pay now", we reserve the yacht as an option with the charter company and forward you to Revolut's payment page, which is valid for 30 minutes. Before you pay, you see the total price, the amount due now and, where applicable, the balance with its due date.

By completing the payment, you make a binding offer to conclude the charter contract. The contract is concluded when we have confirmed the booking with the charter company and send you the booking confirmation by email. If you do not complete the payment within these 30 minutes, the option lapses at no cost to you and the yacht is no longer reserved for you. If the booking cannot be confirmed despite payment, we will inform you without delay and refund the amount paid in full without delay (section 6).

6. Prices and payment

All prices are in euros. The price stated in the offer or booking confirmation applies. Costs not included in the charter price, such as security deposit, final cleaning, fuel, marina and port fees, tourist tax, transit log, skipper, crew, advance provisioning allowance (APA) or extra equipment, are shown in the offer where known; some are payable directly to the charter company on site.

For instant bookings and, unless the offer states otherwise, for all other bookings, the following applies:

We are entitled to accept payments on behalf of the charter company. You pay online via Revolut or by bank transfer. About 14 days before the balance is due, we email you a payment request with a link through which you can pay it online via Revolut; if it is still outstanding after the due date, we remind you once more. In case of late payment, we charge statutory default interest and the necessary and reasonable costs of collection (§ 1333(2) Austrian Civil Code). If a payment due remains outstanding after a grace period of 14 days, the charter company may withdraw from the contract; the cancellation terms under section 8 then apply.

We make refunds to the payment method you used (via Revolut for online payments), otherwise by bank transfer to an account you specify.

7. No right of withdrawal for yacht charters

A yacht charter is a service related to leisure activities for a specific period. Consumers therefore have no right of withdrawal under the Austrian Distance and Off-Premises Contracts Act for charter contracts concluded at a distance (§ 18(1)(10) FAGG). Cancellation is possible under section 8.

8. Cancellation by the customer

Please cancel in writing, by email to office@pinhoff.com or in the MUTINYQUE app via "Ask about this booking" with the topic "Cancellation". The date of receipt by us counts.

For instant bookings (section 5), the cancellation fees as a percentage of the charter price are:

For all other bookings, the charter company's cancellation terms take precedence if we state them to you before booking. If we have not stated any, or they contain no provision, the following cancellation fees apply as a percentage of the charter price:

If your payments exceed the cancellation fee, we refund the difference (section 6). The court's right to reduce contractual penalties (§ 1336 Austrian Civil Code) remains unaffected. We recommend taking out travel cancellation insurance.

9. Changes and rebooking

Rebookings are possible only subject to availability and with the charter company's consent. Additional costs and price differences are borne by the customer. There is no right to free rebooking.

10. Cancellation or non-performance by the charter company

If the charter company cannot provide the booked yacht or not as agreed, we will inform you immediately and try to find an equivalent replacement yacht. If you do not accept a replacement, payments already made will be refunded in full (section 6). Claims for defects in the charter service are directed against the charter company; we will support you in asserting them.

11. Customer obligations

The customer undertakes:

12. Consultation appointment (Private Yacht Advisory)

A consultation is a personal video call about buying, selling, owning and chartering yachts. The price is shown on the website and includes statutory VAT. It is payable on booking via Revolut. The contract for the consultation is concluded when payment is completed. We email you the invoice after the appointment, once you have confirmed your email address via the link in our email.

You choose a preferred date. After payment, we confirm the appointment by email and send the video call link. If the date does not suit us, we propose another; if no suitable date can be found, we refund the amount in full. Rescheduling is possible by arrangement. If the preferred date falls within the 14-day withdrawal period, consumers can book only if, when booking, they expressly request that the consultation take place before the period ends and acknowledge that they lose their right of withdrawal once the consultation has been fully performed (see section 13). If we later agree on a different date within the withdrawal period, the same applies: we will obtain your express request and acknowledgement by email beforehand.

The consultation is based on our experience and the information available to us. It does not replace legal, tax or technical advice (such as an expert report or survey). You make decisions on your own responsibility.

13. Right of withdrawal for consumers for consultation appointments

Withdrawal policy

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (PINHOFF GmbH, Am Kluggrund 18, 8511 Sankt Stefan ob Stainz, Austria, email office@pinhoff.com, phone +43 664 6464186) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

The right of withdrawal expires once we have fully performed the service, if performance began with your express prior consent and your acknowledgement that you lose your right of withdrawal once the contract has been fully performed.

Model withdrawal form

(Complete and return this form only if you wish to withdraw from the contract.)

14. Brokering the purchase and sale of yachts

Information on yachts for sale comes from the seller or the shipyard. We pass it on with care but do not check it technically; before buying, we recommend an inspection and an independent survey. The purchase contract is concluded directly between buyer and seller. Our commission and further terms are agreed in writing in each case.

14a. Job ads on the job portal

At www.mutinyque.com/en/jobs/inserieren, companies and individuals looking for staff for yachts, charter, shipyards, marinas and related fields ("employers") can place job ads. Packages, run times, services and net prices are shown on that page. VAT is added to the net prices if the employer is based in Austria or in another EU country without a valid VAT ID; businesses in other EU countries with a VAT ID and employers outside the EU are invoiced without VAT (reverse charge for EU businesses). You see the total price before paying.

The contract for the ad is concluded when the payment via Revolut is completed; if you pay by invoice, with our confirmation by email. We email the invoice once you have confirmed your email address; if you pay by invoice, it is payable by bank transfer within 14 days without deduction. No fee is charged during a free launch phase.

We review every ad before publication. We reject ads that break the law (in particular the requirement of gender-neutral job ads under the Austrian Equal Treatment Act), are misleading, do not describe a real vacancy, ask applicants for money or do not fit the yachting industry. If we reject an ad, we cancel the invoice and refund any amount already paid in full.

The run time starts on approval (Basic 30 days, Plus and job subscription 60 days). After that the ad goes offline automatically; beforehand we send an email reminder about renewing. An earlier "apply by" date ends the ad on that day. Plus and job subscription ads are listed at the top and marked; we also feature them on Instagram and in the next MUTINYQUE newsletter. We do not guarantee a particular number of applications.

The employer is responsible for the content of the ad. The employer confirms that the information is correct and the position is genuinely vacant, and allows us to publish the ad on our website, on Google Jobs, in our newsletter and on our social media channels. For job portal ads (Basic, Plus or free of charge during the launch phase), applications go directly to the employer's email address or page; we do not receive or store any applicant data. For positions that partners post in the partner area, including with the job subscription, applicants can also apply in the MUTINYQUE app; we store these applications on the partner's behalf and show them only to the partner's company in the partner area. The employer alone is responsible for selecting applicants and for the employment relationship.

Partners book the job subscription in the partner area. It covers up to five ads running at the same time with the Plus services and is charged monthly or yearly in advance via Revolut. It can be cancelled at the end of each billing period and remains usable until then; a change of interval applies from the next period.

If the employer is a consumer, they may withdraw from the contract within 14 days of its conclusion without giving reasons (declaration and model form as in section 13). We then refund any amounts already paid in full and take a published ad offline.

15. Liability

We are liable for careful brokerage and our own services. We are not liable for the services of the charter company and other service providers unless we ourselves are at fault in selection, information or transmission.

We are not liable for damage caused by slight negligence. This does not apply to personal injury and, towards consumers, to damage to items we have accepted for processing. Towards businesses, we are also not liable for loss of profit and consequential damage in cases of slight negligence. Mandatory statutory liability remains unaffected.

Neither party is responsible for events of force majeure (such as severe weather, natural disasters, war, pandemics, official orders, port closures). If the charter becomes impossible as a result, your claims, in particular for refunds, are governed by the charter contract and the law.

16. Insurance

We recommend taking out suitable insurance, in particular travel cancellation insurance, skipper liability insurance, security deposit insurance, and health and accident insurance including repatriation.

17. Data protection

How we process your data is described in our privacy policy at www.mutinyque.com/en/privacy.

18. Electronic communication

We usually communicate with you by email. You receive offers, booking confirmations and invoices electronically.

If you have sent an enquiry, booking or order through the website, you can view the status of your enquiries and bookings in the customer area (www.mutinyque.com/en/konto). The customer area is a voluntary, free service with no entitlement to constant availability. The display is for information only; the offer, booking confirmation and charter contract are binding. The status is synchronised every night and may lag behind until then. Access is personal; we may block it in case of misuse. Please continue to declare changes and cancellations as described in sections 8 and 9.

19. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. For consumers habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.

For actions against consumers, the court in whose district the consumer is domiciled, habitually resident or employed has jurisdiction (§ 14 KSchG). For businesses, the competent court in Graz has exclusive jurisdiction.

20. Dispute resolution

The EU online dispute resolution platform was discontinued on 20 July 2025. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. Please send complaints to office@pinhoff.com.

21. Language and final provisions

The German version of these terms is authoritative. Translations are for information only.

The terms in the version published at the time the contract is concluded apply. If a provision is invalid, the remaining provisions remain valid. Towards businesses, the invalid provision is replaced by a valid one that comes closest to its economic purpose.
